TGC Diversao is operated by Tway Global Communications Limited. By creating an account, accessing our website, or using our services, you agree to these Terms of Service. If you use the services for an organization, you confirm that you are authorized to accept these terms for that organization.
2. Accounts and access
You must provide accurate registration information, including a valid email address and phone number, and keep it current. You are responsible for protecting account credentials, API keys, and all activity under your account. Tell us promptly if you suspect unauthorized access.
3. Communications services
Our services may enable SMS, RCS, WhatsApp, voice, verification, and related communications. Availability, sender types, throughput, features, and delivery depend on destination, carrier, channel provider, local rules, and the commercial plan agreed with you. Delivery is not guaranteed for every message or call.
4. Your responsibilities
You must obtain and document every consent required to contact recipients. You must honor opt-outs, suppression requests, quiet hours, content restrictions, and applicable telecommunications, privacy, consumer protection, and marketing laws. You may not use the services for fraud, harassment, unlawful surveillance, deceptive traffic, emergency services, or content that infringes another person's rights.
5. Acceptable traffic
You must identify yourself accurately, use approved sender identities, and provide clear opt-out and help instructions where required. We may filter, throttle, suspend, or reject traffic to protect recipients, networks, our platform, or legal compliance. You remain responsible for the content and destination of communications you initiate.
6. Fees and taxes
Paid services are governed by the pricing, currency, billing cycle, minimum commitments, and taxes shown in your order form or account. Usage-based charges may include carrier or channel fees. Unless an agreement says otherwise, fees are non-refundable once the related service or usage has been provided.
7. Service changes and availability
We may update services to improve security, comply with network requirements, or add and remove features. Planned maintenance and events outside our reasonable control may affect availability. Any service-level commitment applies only when it is written in a separate agreement.
8. Intellectual property
We retain all rights in the TGC Diversao platform, software, documentation, and brand. You retain rights in your applications, data, and message content. You grant us the limited rights needed to process your data and traffic to operate, secure, support, and improve the services.
9. Suspension and termination
You may stop using the services at any time, subject to your commercial commitments. We may suspend or terminate access for material breach, security risk, unlawful traffic, non-payment, network partner instruction, or conduct that threatens other users or recipients. Sections that by nature should survive termination will continue to apply.
10. Disclaimers and liability
To the maximum extent permitted by law, services are provided on an "as available" basis. We do not promise uninterrupted delivery or compatibility with every carrier or device. Neither party is liable for indirect, incidental, special, or consequential loss. Any additional limits or remedies in a signed customer agreement take priority over this section.
11. Governing terms
A signed order form, data processing agreement, or master services agreement may add to or replace parts of these terms. The governing law and dispute process in that agreement apply. If there is no separate agreement, the applicable law and competent courts will be determined by mandatory law and the parties' relevant place of establishment.
